Terms & Conditions

1. The Service

MyPicasso provides a mobile and web platform that allows parents and guardians to:

• Photograph and store images of their children's artwork
• Build personalised art books using those images
• Order professionally printed physical copies of those books for delivery within South Africa

2. Eligibility

You must be at least 18 years old to create an account and use MyPicasso. By registering, you confirm that you are 18 or older and that all information you provide is accurate and truthful.

3. Your Account

• You are responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately at support@mypicasso.co.za if you suspect unauthorised access to your account
• We reserve the right to suspend or terminate accounts that violate these terms

4. Your Content

• You retain full ownership of all artwork images and content you upload to MyPicasso
• By uploading content, you grant MyPicasso a limited licence to store, display, and print that content solely for the purpose of providing the service to you
• You confirm that you are the parent or legal guardian of the child whose artwork you upload, or that you have permission from the child's parent or guardian
• You must not upload any content that is illegal, offensive, or infringes any third party's intellectual property rights
• We will never share, sell, or use your uploaded content for any purpose other than providing the service

5. Orders and Pricing

• All prices are displayed in South African Rand (ZAR) and include VAT where applicable
• Shipping is charged at R89 per order, delivered anywhere in South Africa
• Prices are subject to change at any time, but changes will not affect orders already placed
• An order is only confirmed once payment has been successfully processed
• We reserve the right to cancel any order if we are unable to fulfil it, in which case a full refund will be issued

6. Payment

• All payments are processed securely by PayFast, a South African payment gateway
• MyPicasso does not store, access, or process your card or banking details directly
• By placing an order you agree to PayFast's terms and conditions
• All transactions are encrypted and secured

7. Delivery

• We aim to print and deliver all orders within 7–10 business days from order confirmation
• Delivery is available to all provinces in South Africa
• MyPicasso is not responsible for delays caused by courier services or circumstances outside our control
• Risk of loss passes to you once the order is handed to the courier

8. Intellectual Property

The MyPicasso name, logo, app, and website design are the intellectual property of Tyrone Lasarow. You may not copy, reproduce, or distribute any part of the MyPicasso platform without our written consent.

9. Limitation of Liability

• MyPicasso provides the service on an "as is" basis
• We do not guarantee uninterrupted or error-free service
• To the maximum extent permitted by South African law, MyPicasso shall not be liable for any indirect, incidental, or consequential loss or damage arising from your use of the service
• Our total liability to you shall not exceed the amount paid for the order in question

10. Termination

• You may delete your account at any time by contacting support@mypicasso.co.za
• We may suspend or terminate your account at any time if you breach these terms
• Upon termination, your data will be deleted in accordance with our Privacy Policy

11. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.

12. Changes to These Terms

We may update these terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use of the service after changes constitutes acceptance of the updated terms.
